📄 General Terms and Conditions (GTC)
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between
Burnout2Business Stefanie Greiter c/o IP-Management #3763 Ludwig-Erhard-Str. 18 20459 Hamburg Germany
(hereinafter referred to as “Provider”) and the customer via the website www.burnout2business.de.
(2) Deviating terms and conditions of the customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
2. Subject matter of the contract
(1) The provider makes various digital content available on its website:
a free PDF freebie (download after registering for the email list),
a paid e-book (digital product, sold via the payment provider Stripe Payments Europe Ltd.).
(2) In addition, the provider recommends third-party products on its website, in particular the “Digital Wealth Academy” course (sale and processing exclusively via Fanbasis.com). This is an affiliate link. If a contract is concluded via this link, the respective third-party provider is the sole contractual partner of the customer.
(3) The provider itself does not provide any shipping or delivery services in physical form. All products are digital content within the meaning of Section 327 (2) of the German Civil Code (BGB).
3. Conclusion of contract
(1) Free freebie:
The contract for the use of the free PDF download is concluded when customers enter their email address in the registration form and confirm their registration via double opt-in.
(2) E-book (digital product via Stripe):
The paid e-book can be ordered directly via the payment link (Stripe Checkout) integrated on the website. Before completing the purchase, customers must expressly confirm by ticking a checkbox that they agree to the execution of the contract (provision of the download) before the expiry of the statutory withdrawal period and that their right of withdrawal thereby expires. Only after this confirmation and successful payment will the download link be automatically provided. The contract is concluded as soon as the payment via Stripe has been successfully completed.
(3) Affiliate links (courses via Fanbasis.com):
If a purchase is made at Fanbasis.com via an affiliate link, the contract is concluded exclusively between the customer and Fanbasis.com or the respective provider. The provider merely mediates the contact and may receive a commission for this.
4. Prices and payment terms
(1) All prices are quoted in euros and include statutory sales tax unless otherwise stated.
(2) As a small business owner within the meaning of Section 19 of the German Sales Tax Act (UStG), the provider does not charge sales tax. All prices quoted are final prices.
(3) Payment processing is handled by the service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (“Stripe”). Stripe offers various payment methods, including credit card, debit card, Apple Pay, and Google Pay. The payment data is transmitted directly to Stripe; the provider itself does not receive any complete payment information (e.g., credit card numbers). After successful payment, an invoice is automatically generated and sent to the customer by email.
(4) For affiliate products, the prices and payment terms of the respective third-party provider (e.g., Fanbasis.com) apply.
5. Delivery and access to digital content
(1) Digital products will be made available to customers immediately after receipt of payment or registration via email or download link.
(2) The payment and invoicing process is provided by Stripe. The provider accepts no liability for any technical malfunctions on the part of Stripe.
(3) The provider accepts no liability for the availability and functionality of third-party platforms (e.g., Fanbasis.com).
6. Right of withdrawal
(1) Free freebie: As this is a free offer, there is no statutory right of withdrawal.
(2) E-book (digital product): Consumers generally have a statutory right of withdrawal of 14 days. However, this right of withdrawal expires prematurely as soon as the customer expressly agrees that the execution of the contract (provision of the download) will begin before the expiry of the withdrawal period and at the same time confirms that they are aware that the right of withdrawal expires with the start of execution. This consent is given via a mandatory checkbox at checkout and is technically documented.
(3) Affiliate products (e.g., courses via Fanbasis.com): The withdrawal and return rights of the respective third-party provider apply to these. The provider is not responsible for this.
7. Liability
(1) The provider shall be liable without limitation for damages resulting from injury to life, limb, or health caused by intentional or negligent breach of duty.
(2) Otherwise, the provider shall only be liable for intent and gross negligence.
(3) The provider accepts no liability for the content, services, and technical availability of third-party providers (e.g., Stripe, Fanbasis.com, Brevo, Hostinger).
8. Copyright
(1) All digital content provided by the provider (texts, images, PDFs, e-books) is subject to copyright.
(2) The content may not be passed on, reproduced, or made publicly available without the express permission of the provider.
9. Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction for all disputes is – to the extent permitted by law – the registered office of the provider.
